In a Monday afternoon hearing, Hamilton Criminal Court Judge Boyd Patterson said the Budgetel may reopen under certain conditions set by the court.
The judge said the owner of the extended stay facility must place video surveillance cameras around the property and provide access to the videos to the East Ridge Police Department. A strict 120-day limit will be imposed on anyone staying at the motel. If found in violation of the time limit, the owner would be subject to a $500 per day fine per resident. Those staying at the motel will not be allowed to pay in cash.
Budgetel owner Amish Patel said he will begin work to address the deficiencies found during inspection by authorities. He expected to have the work completed by January 11.
Residents who were evicted on November 16 will have until December 22 to retrieve items left behind.
Hamilton County District Attorney Coty Wamp filed a complaint with the court on Nov. 14 alleging the extended stay motel was a public nuisance due to an exceedingly high volume of calls for service by ERPD.
The residents discovered the pending action on Nov. 15 when school officials informed students and parents who lived there that they were going to be evicted.
