Editors Note: The following minutes are from the May, June and July meetings of the East Ridge Housing Commission.
The East Ridge Housing Commission met pursuant to notice on May 1, 2019, 3:30 pm at East Ridge City Hall. Chairperson Winters called the meeting to order.
Present were:Chairperson Winters, Boardmember Broome, Boardmember Stephens, Boardmember Wilson and City Attorney Litchford.
Absent were: Boardmember Rogers
Chairperson Winters led everyone in the Pledge of Allegiance to the Flag.
1612 Castleberry Avenue – The property was found in violation by the Housing Commission of the 2018 International Property Maintenance Code Sections 108.1 – Unsafe Structures, 108.1.2 Unsafe Equipment, 108.1.3 Structure Unfit for Human Occupancy, and 108.1.5 Dangerous Structure or Premises. The property owner requested a stay of any condemnation proceedings to allow him time to bring the code violations into compliance.
The Housing Commission moved an approved to stay condemnation and demolition of the property. The property owner is required to immediately commence efforts to have the property brought into compliance including obtaining permits to repair the flooring and electrical issues.
The Property owner shall appear on June 10, 2019 for a review of the updates on the improvements and to discuss action plans about the Property. The Property Owner is responsible for contacting Code Enforcement to arrange a meeting at the property to allow for inspection of all repairs and improvements and to coordinate the necessary repairs to bring the property back into compliance.

1503 McDonald Drive (Waverly Motel)– The structure (Motel) was deemed unfit for human habitation by the Housing Commission pursuant to Sections 13-307 and 13-309 of the East Ridge City Code. Repairs shall be immediately initiated to fix the plumbing, electrical, heating, smoke alarms, and infestation.
The structure (Motel) was also found by the Housing Commission to be in violation of Section 13-314 of the East Ridge City Code for dirt, filth, rubbish, garbage, and failing to be free from rodent or vermin infestation. There was evidence presented of insanitary material in plumbing fixtures, including sinks.
The Housing Commission found that emergency conditions exist under Section 109-1 of the 2018 International Property Maintenance Code. There exist imminent dangers as a result of endangerment to life which is actually or potentially dangerous to occupants as a result of the aforementioned violations.
The Housing Commission moved and approved that based on the dangers on the Property, occupancy of the structure (Motel) is temporarily suspended, prohibiting anyone from occupying the structure (Motel). The Property Owner shall immediately move to remedy all code violations.
The Property Owner shall return on Monday May 13, 2019 at 5:30 pm to give an update to the Housing Commission as to what has been done to bring the code violations into compliance. At that time the Housing Commission will consider if any additional actions may be taken relative to the Property including without limitation the extension of the prohibition of occupancy.

715 Belvoir Avenue – The Housing Commission moved and approved to close this matter and dismiss in its entirety.
4020 Wade Drive – The Housing Commission moved and approved to close this matter and dismiss in its entirety.
626 Marlboro Avenue – The Housing Commission moved an approved to bring this case back on July 8, 2019 for an update on progress. The owner is not required to attend this hearing.
1619 Barry Road – The Housing Commission moved an approved to bring this case back on July 8, 2019 for an update on progress of obtaining the deed.
2005 Prigmore Road – The Housing Commission moved and approved to pass this case to June 10, 2019 giving the owner time to contact a contractor.
1317 Pleasant Street – The Housing Commission moved and approved to have this matter set for a hearing on June 10, 2019 to Show Cause, if any why condemnation actions including demolition of the property shall not be initiated.
418 Cedar Glen Circle – The Housing Commission moved and approved to have this matter set for a hearing on June 10, 2019 to Show Cause, if any why condemnation actions including demolition of the property shall not be initiated. Code Enforcement shall immediately issue a post for clean up on the property.
1700 Prigmore Road – The Housing Commission moved and approved to have this matter set for a hearing on June 10, 2019 to Show Cause, if any why condemnation actions including demolition of the property shall not be initiated. Property owners must bring a licensed contractor to the hearing to testify with regard to the property and code violations. Property owners must also obtain a Flood Elevation Certificate from a licensed surveyor before the June 10, 2019 hearing. Failure to comply with the Order may result in the demolition of the structure on the property.
4308 Dupont Street – The Housing Commission moved an approved to bring this case back on June 10, 2019 for an update on progress.
4165 East Ridge Avenue – The Housing Commission moved and approved to pass this case to July 8, 2019 giving the new owner time to correct all code violations on the property.
39 Frawley Road – The Housing Commission moved and approved to have the structure on the property demolished within thirty (30) days of the May 13, 2019 hearing.
1503 McDonald Road –The Housing Commission moved and approved to have the Owners appear on June 10, 2019 for a follow up report relative to the operations of the motel and the compliance with all property maintenance and code violations. The Commission at that time will consider what, if any, additional actions may be taken relative to the property.

1503 McDonald Road– The Housing Commission moved and approved to lift the restriction on unit numbers 110 and 118. The Commission moved and approved to close this case and dismiss in its entirety.
3220 Gleason Drive – The Housing Commission moved and approved to stay any demolition of the dwelling until August 12, 2019. The owner shall complete the process of obtaining his contractors license as owner represented, he intended. The owner shall start cleaning up of the property immediately to substantially improve the property. Property owner is responsible for contacting Code Enforcement to arrange an inspection of the progress.
2005 Prigmore Road – The Housing Commission moved an approved to have the structure demolished within thirty (30) days the Housing Commission Order. If the owner fails to demolish the structure within thirty (30) days, the City will demolish, and a lien will be placed against the property.
1612 Castleberry Avenue – The Housing Commission moved and approved to pass this case to July 8, 2019.
1317 Pleasant Street – The Housing Commission moved and approved to have all parties having interest to appear for a SHOW CAUSE hearing to discuss why condemnation, including without limitation demolition of the property shall not be initiated.
4308 Dupont Street – The owner of the property has decided to have the structure on the property demolished. The Housing Commission moved and approved to pass this matter to July 8, 2019.
1700 Prigmore Road – The Housing Commission moved an approved to have the structure demolished within thirty (30) days the Housing Commission Order. If the owner fails to demolish the structure within thirty (30) days, the City will demolish, and a lien will be placed against the property.
626 Marlboro Avenue – The Housing Commission moved and approved to close this case and dismiss in its entirety.
6619 State Line Road – The Housing Commission moved and approved to pass this case to July 8, 2019.

The Owner and a representative from MG Development shall appear to defend the validity of the substantial improvement analysis dated March 15, 2019. The Housing Commission will determine at that time what, if any additional actions shall be taken against the property, including without limitation demolition of the structure.

1619 Barry Road – The owner is still waiting on signatures to get a clear deed. The Housing Commission moved and approved to pass this matter to the August 12, 2019 hearing.
6619 State Line Road – The Housing Commission moved and approved to pass this case to the August 12, 2019 meeting. This is a Show Cause Hearing to show why condemnation actions relative to the property, including demolition of the property shall not be initiated. The Code Enforcement Department has determined that the property is within the 100-year flood. The property owner is required to submit, before the August 12, 2019 hearing a FEMA Substantial Improvement Form showing the estimated cost to improve the property in order to bring the property/structure into compliance with current codes.
1317 Pleasant Street – The Housing Commission moved and approved to pass this matter to the August 12, 2019 hearing. The owner is going to obtain a private appraisal of the property.
5314 Dupont Street – The Housing Commission moved and approved to pass this matter to the August 12, 2019 hearing. This is a Show Cause Hearing to show why condemnation actions relative to the property, including demolition of the property shall not be initiated. The property owner and the occupant are required to allow for an interior inspection of the dwelling on July 19, 2019.
