A man accused of raping a 13-year-old girl on Monday has had a hold placed on him by U.S. Immigration and Customs Enforcement, court officials said Wednesday.
Sebastian Perez-Gomez, 38, of a Dugan Street address, was charged Monday evening with Rape. He is being held in the Hamilton County Jail under a $1.5 million bond. Perez-Gomez is due to appear in East Ridge Municipal Court on May 28.
According to an affidavit of complaint, police were dispatched to an address on Dugan just after 6:30 p.m. in regard to a rape. Officers were met by the girl’s father who said that his daughter had been raped by Perez-Gomez, his brother-in-law. who also lives in the home.
According to the report, the juvenile victim told police that she had been in bed taking a nap when she awoke to Perez-Gomez attempting to take off her clothes. She told officers that she began fighting him off and was able to get to her feet after kicking him off of her. The report states that Perez-Gomez was able to overpower the girl and force her to the floor and forcibly penetrate her.
The victim was taken by ambulance to Erlanger Children’s Hospital accompanied by her father.
The report states that officer “cleared the scene,” but an officer returned to the home just before 11 p.m. and saw the suspect’s vehicle in the driveway. When officers knocked on the door, the suspect’s wife answered and told police he was not there. The report states officers spoke with the victim’s father over the telephone and received permission to search the home.
Once inside, the report states, police noticed that the back door to the home was wide open, leading officer to think Perez-Gomez took off on foot out the back. Officers immediately began searching the area in an effort to locate the suspect. He was found hiding in a tree in some woods about 150 yards from the house.
According to the report, officers employed an interpreter to interview Perez-Gomez who told police that he entered the girl’s room “and a tussle ensued.” The suspect said the victim hit him in the head. The report states that Perez-Gomez changed his story stating in fact that he did remove the victim’s shorts. He said that he didn’t remember if he “was going to rape her or if he just wanted to play with her.”
Perez-Gomez was subsequently placed under arrest for rape and transported to the jail.
