Early Monday morning an East Ridge police officer was injured during an incident in the parking lot of the Waverly Motel.
According to an affidavit of complaint, Allan David Rice, a 26-year-old homeless man, was charged with Aggravated Assault on Police, Possession of a Firearm while in Commission of a Felony and Resisting Stop, Frisk, Halt, Arrest or Search. He is being held in Hamilton County Jail on a $45,000 bond.
The report states that an officer was patrolling behind the Waverly Motel just after midnight on Monday when she saw two women inside a silver 2017 Jeep with Ohio tags parked on the back side of the lot. The officer circled back through and saw the two women still inside the Jeep.
It was noted in the report that the Waverly Motel is a location with a well documented history of narcotics use and trafficking, stolen vehicle recoveries and other criminal complaints.
When the officer got out of her cruiser, she noticed a third person in the Jeep, a male wearing an army jacket.
The report states that the driver of the Jeep told the officer that they were waiting to rent a room, despite the fact they were behind the motel and not adjacent to the office. The officer noticed a gun holster sitting next to the male in the rear passenger’s seat. The man, later identified as Rice, appeared to be manipulating his hands while claiming to be looking for his identification.
The report states that police told Rice to show his hands and then attempted to remove him from the vehicle. Rice had to be dragged from the Jeep and he continued to struggle. It was then that an officer saw a firearm in the waistband of Rice’s pants. Police continued to struggle with Rice after seeing the gun. The report states that Rice “continued to reach his hand in his waistband area and at one point he was successful at reaching back into his pocket.”
A second officer was able to pull the weapon from Rice’s waistband during the confrontation. Rice continued struggling and was taken to the ground as he continued to conceal his arms and pull away. The report states that Rice was tased and subsequently taken into custody.
The firearm, a Taurus 9 mm was found to be fully loaded with a round in the chamber, the report states.
According to the report, Rice is currently on bond for Aggravated Domestic Assault and has additional felony warrants out of Walker County, Georgia. Rice was taken to an area hospital after having been tased. He was cleared and transported to the jail.
Officials said a male officer suffered a fractured hand during the incident. That officer, who was not identified in the report, will be placed on light duty due to the injury.
